Delhi RERA restricts real estate transactions in Sky Mansion Project

In a bid to ensure builders comply with RERA regulations, Delhi RERA has directed Brilliant Etoile Pvt Ltd to restrict real estate transactions for its project Sky Mansion in Chattarpur, Delhi. The decision came soon after Haryana RERA deregistered a few real estate projects in Gurgaon.

Soon after Haryana RERA restricted the sale and purchase of a few projects in Gurgaon, Delhi RERA has also taken similar action against a default builder. Brilliant Etoile Pvt Ltd registered its luxurious project Sky Mansion under Delhi RERA in July 2018. The project was likely to be completed by August 2021 but the developer sought an extension of nine months to complete the project by May 2022 due to the pandemic. The delay in project completion has risen several discrepancies related to the building plan and land title. Therefore, the Authority has directed the builder to not engage in real estate transactions until the pending issues are resolved.

Why has Delhi RERA barred bookings in Sky Mansion project?
As per Delhi RERA, the under construction Sky Mansion project in Chhatarpur requires revalidation of its expired building plan and land title. The validity of the approved building plan expired in March 2022, and the validity of registration was exhausted in May 2022. In addition, the land parcel for the construction of the Sky Mansion project is disputed. The ownership of the plot comprising 10 Biswas in village Chandan Hola is not clear yet. Therefore, the Authority demands proper ownership reports to give a clean chit to the project.

What has Delhi RERA directed to the builder?
Due to pending issues, the RERA authority has restricted the developer to enter into an Agreement of Sale, entertain fresh bookings and even collect further money from the allottees in its high end housing society in Chattarpur.

What are the next steps taken by the builder?
Since Brilliant Etoile has sought an extension of building plan from Municipal Corporation of Delhi (MCD), the Authority has not asked the developer to stop the construction work of the project. The builder has also sought further extension of registration under Delhi RERA up to February 2023. However, the developer will have to comply with the RERA regulations to reinitiate the real estate transactions and get the title cleared.
