DTCP bans property sale in a housing society in Sector 90 Gurgaon
After banning sale transactions in Palam Vihar, the Department of Town and Country Planning (DTCP) has now halted the execution of sale deeds and registration of properties of a housing society in Sector 90 Gurgaon. The action has been motivated by the unscrupulous activities of the developer.
The citys Department of Town and Country Planning (DTCP) has directed the local authorities to stop all property related transactions of a group housing society in Sector 90 Gurgaon. The move is aimed at putting an end to illegal agreements by developers in Gurgaon and send out a strong message discouraging the same. The decision is reminiscent of other such instances from August and September 2022 that took place in the localities of Palam Vihar and Sushant Lok Phase 2.
What has motivated such action from DTCP?
The department has revoked the license of a housing project in Sector 90 Gurgaon as the developer had promised 35 percent saleable area to land owners however, unpermitted deals with other developers were unearthed later. Consequently, sale and purchase of properties on the project has been halted. Upon investigation, the department found that the developer had not taken the necessary permissions before involving third parties. As per Amit Madholia, District Town Planner (enforcement), The DTCP has ordered to freeze the inventory of the colony, and directed the tehsildar of the revenue department to stop sale deed registrations of the property, and make a red entry in the records.
What action was taken by DTCP in the previous cases this year?
As per norms, developers are required to renew their projects licenses after a period of time. This had not been done in the case of Palam Vihar. Also, the department had not received the Internal Development Charges (IDC) and External Development Charges (EDC) for this colony which is situated near the Delhi border. Taking action over non compliance of rules, a ban was put to stop any future transaction of the property until further orders.
In June 2022, a similar order was passed for another locality, Sushant Lok 2, situated on the Golf Course Road. Due to the non renewal of licenses, the DTCP banned the registration of properties. Ansal Buildwell, the developer, had not renewed their colonys licenses, despite repeated orders from the department. However, later, a clarification was issued, and the order applied to only the developer owned properties.
Although DTCP is taking active steps to ensure that developers are kept under necessary checks, it may often not bear well for homeowners as axed projects can face potential hindrances when placed in the secondary market for resale.
